None of the above changes the fact that there is no "debt" until a court says there is and that it is the driver who is liable and not the registered keeper.

There is no case in Scotland of a driver being taken to court where the driver did not make themselves known to the pursuer.

In general, in Scotland, car parking fees near hills are often supporting path repair and erosion control.

Thousands of man hours near Arrochar on path repair (contrast to Beinn Ime with its mud bath over the estate boundary).

Parking fees at places like Glen Muick are often being ploughed into COAT - who have repaired some of the serious scars that we have created (Bynack, Sron na Lairig etc etc).

Social media often sees folks presenting themselves as a hybrid of Rob Roy MacGregor and Che Guevara in their opposition to paying for parking.

I suspect that most of them are chucking large quantities of cash on themselves on gear, cars, fuel, accommodation and, having short arms and long pockets, can't abide to contribute where they can wiggle out of it.

They often assert that taxes should cover it - there is a decent argument for that as we should be encouraging healthy activity. However, the general populus is often inclined to think that we should all have insurance and pay for MR, I'm not convinced that they really want benefits, health and education to have funds diverted to a minority, albeit healthy, pursuit.

I think you are getting the Scottish hillwalker mixed up with Lewis Hamilton. Maybe he could offer to pay for every hillwalkers car park in Scotland out of his tax avoidance scheme.

I might start a petition. :D

Well...evidence of actual positive action would be a breath of fresh air. :clap:

The norm on social media is for self-interested demands to be clad in right-on political camouflage.

A little like asserting that tax avoidance should be channelled into hillwalkers' car parking costs - personally I'd see it channelled into education and health first.

But then Bo and Luke, like Rob Roy, were looking out for number one at the end of the day weren't they. :wink:

Regarding simple procedure, it now puts the emphasis on the alleged debtor, note alleged, to prove their innocence, the use of automatic number plate cameras supplies the owner of the camera with enough information for a 'bill' to sent out it isn't a fine despite some companies issuing tickets that look very like those issued by councils and the police, not replying doesn't work, saying that you don't know who was driving doesn't work. In the past these companies mostly base in the south, didn't pursue people due to the cost involved, especially in Scotland. Now as we have seen with the nurses and the lady in Fife they have a 'simply procedure' to extort money from motorists, the fife lady's debt when from an astonishing £22000 to £39000 after courts costs, sadly she has had to bankrupt herself.
Oban was a good example, the car park at Argos had signs that you couldn't read as you drove in, signs that by law should display the terms and conditions of the car park before you enter, by the time you walked up to the signs the company already had collected enough information to send you a bill. Oban council was informed and for a while the signage was moved to the entrance, but your information had already been collected!
The DVLA for a price releases this information more details on their website but anyone with a legitimate reason can pay a sum to retrieve driver details from any number plate.
Loch Lomond has proposed to use the same method, cameras and a time limit for parking in some of their carparks.
While most don't mind paying a small sum for hourly parking they don't agree with a £90 fee for being 10 minutes late getting back to their car.
The simple procedure has made debt collection easier in Scotland for small sums 50p to £3000, Capita's recently boasted that they are 'growing their debt recovery business on top of running the, police, nurses and teachers pension, DVLA business and anything else that government have privatised with them.
The killer word today is monetize.

In the Lake District, the car parks controlled by number plate recognition cameras which we used allowed 15mins for free and you pay when you're about to leave. This means you can decide not to stay if you decide against it within 15mins and no overstay fine as you pay when you leave.
